Anthropic Confirms Claude Code Now Steers Away From Recreating Existing Games

Primary source: Addy Osmani (Anthropic) on X, Oct 30, 2026, 12:58 PM ET. An Anthropic spokesperson pointed GameDeveloper.com to this post as the company's statement (GameDeveloper.com, Oct 30). Policy: Anthropic Usage Policy. Checked Oct 30, 2026 ~9 PM ET.
Oct 30, 2026: If you've been asking Claude Code to "rebuild [famous game], but call it something else," that's now meant to stop working. Anthropic has confirmed it added a rule to Claude Code's prompt on Opus 5.5 that steers the agent away from recreating a specific existing game. Original games and genre games are still meant to work.
Here's what Anthropic actually said, what came from a third-party discovery, and what's still unclear.
What Anthropic said
Addy Osmani, whom GameDeveloper.com identifies as an Anthropic member of technical staff, replied to the post that first spotted the change:
"We added two sentences to Claude Code's prompt on Opus 5.5 to steer it away from recreating someone else's specific game because using Claude to infringe IP is against our usage policy."
"Original games, genre games, and games built from your own designs and assets are meant to keep working."
"We'll continue to iterate to ensure we're striking the right balance. In the meantime, if Claude turns down something that's yours, send it my way."
GameDeveloper.com reports that an Anthropic spokesperson referred it to this post when it asked for comment.
The policy reference checks out. Anthropic's Usage Policy says you can't use its products to "infringe, misappropriate, or violate the intellectual property rights of a third party."
How it was found (third-party claim)
The change was first flagged by X user chasm (@chasmmmmmmmmmmm) in a post on Oct 30 at 3:01 AM ET. These details come from chasm, not Anthropic:
- Claude Code "picked up a new rule around Oct 27"
- The rule is "sent from Anthropic's servers under a flag called 'tengu_heron_brook'"
- "There's no setting to turn it off"
- The rule text, as chasm quotes it: "Do build original games, games in a genre, and games from the user's own designs and assets. Don't build a recreation of a specific existing game, even if it is renamed or called original."
Anthropic's reply confirms that it added "two sentences" about games. The text chasm quotes is two sentences. But Anthropic didn't repeat the wording, the flag name or the date, so we treat those as reported, not confirmed.
What this means if you make games with Claude Code
Based only on what Anthropic said:
- Still meant to work: original games, games in a genre (a roguelike, a platformer, a farming sim), and games built from your own designs and assets
- Now steered away from: recreating "someone else's specific game," and per chasm's quote, even if you rename it or call it original
- If it refuses your own project: Osmani asks people to send it to him. That's the only appeal path Anthropic has mentioned.
Why now: the AI clone worry
GameDeveloper.com puts the change in context. It reports that indie developers have grown worried about fast AI-made "remakes" reaching the market before the game they copied. These are GameDeveloper's reports, not Anthropic's:
- Digital Sun Games is one of several studios that cancelled a public playtest of its game ReVamp over fears that someone could feed the demo into an AI tool and release a copy
- Developers have pressed Valve on how it will stop clones on Steam, and GameDeveloper says Valve gave developers in South Korea a rare explanation earlier this week
GameDeveloper also notes two limits. Safety rules in AI tools have often been sidestepped with clever prompts. And it's unclear how the tool would know whether a user actually owns a game idea or its assets. It adds that many users replying to chasm pointed out that open-weight models don't have this restriction.
What's confirmed / not confirmed
Confirmed (Anthropic, via Addy Osmani's Oct 30 post, cited by an Anthropic spokesperson): - Anthropic added two sentences to Claude Code's prompt on Opus 5.5 to steer it away from recreating someone else's specific game - The reason given: using Claude to infringe IP is against Anthropic's usage policy - Original games, genre games and games from your own designs and assets are "meant to keep working" - Anthropic says it will "continue to iterate"
Not confirmed: - The exact rule wording, the "tengu_heron_brook" flag and the Oct 27 start date. All come from chasm's post. - Whether users can turn it off. chasm says no; Anthropic didn't address it. - Whether it applies to other models in Claude Code, or to Claude outside Claude Code. Anthropic only mentioned Claude Code on Opus 5.5. - Mods, fan remakes and open-source re-implementations. Anthropic hasn't said how these are treated. - We haven't tested the behaviour ourselves.
